I apologize if you don't get your recommended daily allowance of legal jargon here. In fact, "jargon" is about as legal of a term as you'll find. So grab a drink, here we go...

WEB TEMPLATE COPYRIGHT

If you purchase a web template from me, directly or indirectly, it is licensed to you and I ask that you restrict it to one website only. If it is one-of-a-kind, it will be unique to you, I don't sell the same one twice.

When you purchase a template, you are not purchasing:

  • a logo
  • printable or high resolution graphics
  • individual design elements
  • the right to trademark any part of the template

If you want to use elements to incorporate into a blog, business card, etc. I'm fine with that. Just don't share a copy with anyone else. You paid for it after all...make them buy their own! Copying the template to another site is piracy. You'll walk the plank.

If you wish to sell the template to someone else, please remove it from the original site and do your worst.

SITE CREDITSUnless we've arranged otherwise, please keep my site credits intact at the bottom of the template. If you want to have them removed permanently, I ask that you purchase a license for full rights for an additional $50. Your site will remain in my portfolio.

CLIPART
This is really important. Sometimes I purchase royalty-free clipart to incorporate into the template. This clipart is purchased by me for use on your template. It can NOT be trademarked without explicit written permission from the original artist/photographer.

RESOLUTION
Templates are designed to be viewed on a computer screen, they are low resolution and not designed for printed materials. Please don't come to me and say, "My logo looks weird when I put it on a business card!" Web design is not print design.

REQUESTING ELEMENTS
Should you need individual elements, please ask and I will create and charge appropriately. Time is money, you know!

DIGITAL RIGHTS
You don't need my permission to use the graphics in any other digital format pertaining to your own website, i.e. advertising buttons and/or banners, blog design, etc.

PRINTING RIGHTS
You don't need my permission to use the template graphics in printed materials, but as stated above, you may not be happy with the final results with low-resolution graphics.

 

CUSTOM DESIGNS

When I create a custom design, I will give you a list of questions that I really need you to answer. Each custom design takes between two and four hours, and I try to keep my rates affordable by getting as much information from you, the consumer, before I begin so that I can keep my hours worked to a minimum.

After my first attempt at meeting your criteria, I will send you a screen shot of what I've come up with. You can then tell me what you like and don't like and we go in for round two. I offer three sets of revisions on custom designs, so please be specific. After the third set, I will begin charging hourly. (This almost never happens.)

PEOPLE I RECOMMEND

I have individuals that I trust and recommend for projects, for example, my content writers, artist, photographer and product input specialist. They do not work for me and are not employed by ambermcleod.com. Do business at your own risk. I will not be responsible for anything they say or do, including political affiliations, but I do have them on my site for a reason. I like them, I trust them, and I think you will too.

PRINT MATERIALS

When I create print ready files, I send them to you. Please keep them. Put them on a disk. While I do keep my files on an external drive and have the best intentions of reliable backups, horrifying things happen and I cannot guarantee that your files will be available three years down the road. Just like a newborn baby, once you take it home, it's yours to care for.

Unless you specify the specs and provide a template for me, I will create print materials using my own specs and templates. Please tell me ahead of time if you have specific sizes, bleed limits, crop marks, etc. that your printer requires. It's difficult to add these things after the fact.

As with web design, when I create print materials they are yours to keep. No credit is required.

REFUNDS / RETURNS

I offer digital materials and due to the nature of digital products (i.e. they can be copied in three seconds and redistributed in nine), I do not offer refunds. I will, however, do my very best to make sure you love your product. Once you accept the product, the deal is done.

In regards to tangible printed items, I broker for a large printing firm. They guarantee their work. If you provide the graphic to be printed, it is up to you to make sure it is correct in size and content.

If I provide the graphic to be printed, I will request your approval before sending it to print. Once you have approved the order and provided me with your contact information and payment, I will place the order. If there is an error in printing that you had approved, I cannot issue a refund.

If the error is on that of the printers, I will request a refund or reprint from them. Once granted, I will refund back to you.
